Is it legal for a foreigner to own land or property in Indonesia?
- No, foreigners cannot legally own land in their own name in Indonesia.
- They may legally own leases in their own names.
- Many foreigners attempt to skirt the law by using nominees to hold the titles on their behalf - but this is not without risk.
- It is also lawful to own property through a PMA Company (foreign direct investment company), but in the Badung Regency of Bali these companies are difficult to set up.
Ownership
The law does not allow foreigners to own property in Bali. However, foreigners may legally lease property in their own name. Although there are ways to circumvent the law on owning freehold, our recommendation is to buy a leasehold villa in your own name. We suggest you choose a villa located in a prime area with high rental return potential. If your Villa generates good income then lease extensions become a non-issue and you will have avoided the pitfalls and complications of trying to own freehold outside of the law.

How can I purchase a CK Villa ?
- You can purchase a CK Villa directly through our office in Bali.
- When you purchase directly from developer, the Public Notary will provide you copies of the contracts and facilitate the transaction.
If I decide to purchase a CK Villa what happens ?
Once you have decided on a CK Villa and chosen an available unit:
- Our sales representative will fill out a booking form with your personal information and payment schedule.
- You will be required to pay a nonrefundable deposit of US $10,000.
- Public Notary will provide you copies of the contracts.
- You then have 21 days to go through the contracts and make any necessary amendments.
- Contracts must be exchanged during this after 21 day period your first payment is due.
What happens once I sign the contracts ?
- The contracts will be notarized and sent to the Indonesian Embassy in the country in which you sign them (unless you sign in Indonesia) to be legally formalized.
- This makes the contracts legally binding in Indonesia even though they were signed elsewhere.
How do I make my first payment ?
- You pay directly to developer, PT. Bali Arcon Jaya view details. The receipt of payment will be authorized by a public notary who shall prepare the sales and purchasing agreement
When does the lease commence ?
- The Leasehold Agreement commences upon the start of construction of your Villa
What is included with my Villa ?
- Your Villa comes completely furnished. In accordance with the furniture package based on CK Villas standard for operation as a small resort. Once the villa is completed all you have to do is turn the key to your new villa and enjoy.
Are there any limits to stay in my own villa ?
- No. You and Family and Friends may stay at your own villa during of your holiday period, but there is impact of your revenue as an owner.
Is financing available for foreigners in Indonesia ?
- Indonesian banks will not lend to foreigners against properties in Indonesia, hoowever check with your financial institution in your country of origin regarding your ability to do so outside of Indonesia.
Can the Villa be put under a foreign owned company ?
- The title can be under an Offshore Company based in Indonesia, if structured properly this is the most common practice for managing taxes resulting from capital gains on the Villa.
If I do not have a Foreign Company already set up, is it easy to do so ?
